Service Appendix – Holistic Sport Lab Pathway

This Appendix applies specifically to Holistic Sport Lab services delivered by MoveQ and operates in conjunction with the MoveQ Master Terms and Conditions.

1. Service Nature

  • Holistic Sport Lab provides performance assessment, movement analysis, recovery profiling, and integrated performance insights.

  • The service is educational and performance-oriented in nature.

  • It does not constitute medical diagnosis, treatment, or rehabilitation.

2. Health Disclosure and Suitability

  • Participants are responsible for disclosing any relevant injuries, medical conditions, limitations, or health-related factors prior to participation.

  • MoveQ reserves the right to adjust, limit, or decline participation based on safety or suitability considerations.

  • Participation assumes the individual is fit for non-clinical movement and
    performance assessment unless otherwise agreed in writing.

3. Physical Assessment and Participation Risk

  • The service may include physical testing, movement screening, load assessment, and performance-based protocols.

  • Participants acknowledge that such activities carry inherent physical risk.

  • Participation is voluntary and undertaken at the participant’s own risk.

4. Non-Medical Scope

  • Holistic Sport Lab does not provide medical diagnosis, clinical treatment, or
    physiotherapy services.

  • Participants are advised to seek independent medical or clinical advice where
    appropriate.

  • No aspect of the service should be interpreted as a substitute for professional
    healthcare.

5. Performance Interpretation

  • All assessments, outputs, and recommendations are interpretative and context-dependent.

  • Results do not guarantee specific physical, health, or performance outcomes.

  • Progress is influenced by multiple external and individual factors.

6. Professional Adjustment Rights

  • MoveQ may adapt, modify, pause, or terminate assessments where necessary for: safety, clarity of results, participant suitability, or operational integrity.

  • These adjustments are made to ensure quality and responsible delivery.

7. Data and Performance Information

  • Personal and performance-related data is processed in accordance with applicable European data protection law, including GDPR.

  • Data is used solely for assessment, analysis, communication, and service delivery.

  • Anonymised data may be used for internal development and improvement
    purposes.

8. Intellectual Property

  • All methodologies, assessment systems, frameworks, protocols, and performance models remain the intellectual property of MoveQ.

  • No part of the Holistic Sport Lab system may be copied, reproduced, taught, or
    commercially used without prior written consent.

9. Media and Documentation Consent

  • By participating in Holistic Sport Lab services, participants consent to photography and video recording for:
    performance documentation, analysis, educational use, marketing and communication purposes.

  • MoveQ retains full usage and distribution rights unless otherwise agreed in writing.

  • Opt-out requests must be submitted prior to participation.

10. Liability

  • Participation is undertaken at the participant’s own risk and responsibility.

  • MoveQ shall not be liable for: injury unless caused by proven negligence, pre-existing conditions, personal belongings, or indirect costs related to participation.

  • Participants are advised to maintain appropriate personal insurance coverage.

11. Acceptance

  • By booking or participating in Holistic Sport Lab services, participants confirm that they have read, understood, and agreed to this Appendix and the MoveQ Master Terms and Conditions.

Holistic Sport Lab Terms & Conditions

These Terms and Conditions apply to all services provided by MoveQ, including Education Pathway, Holistic Sport Lab, and 3D PadelFit.

1. Contract Formation

  • A binding agreement is formed only when:

  • Any required application is approved (where applicable), and

  • Full payment has been received by MoveQ.

  • Submission of an application does not guarantee participation.

  • MoveQ reserves the right to decline participation at its discretion.

2. Payment

  • Full payment is required to confirm participation.

  • Failure to pay within the stated timeframe may result in cancellation of access.

3. Cancellation & Rebooking

  • Cancellations made more than 21 days before commencement may be eligible for a partial refund, excluding non-refundable fees.

  • Cancellations within 21 days are subject to a 75% fee.

  • Rebooking is subject to availability and approval.

  • Non-attendance is non-refundable.

4. Changes by MoveQ

  • MoveQ may cancel or reschedule services due to:
    low participation, staffing, safety, force majeure, operational requirements.

  • Participants may choose between:
    refund, or alternative date.

 

MoveQ is not liable for indirect costs (travel, accommodation, etc.).

5. Participant Responsibility

  • Participants must provide accurate information.

  • Participants must follow all safety and professional guidelines.

  • MoveQ may remove participants for misconduct, safety risk, or non-compliance without refund.

6. Liability

  • Participation is at the participant’s own risk.

  • MoveQ is not liable for:

         injury (unless caused by proven negligence), pre-existing conditions, personal             belongings, indirect losses.

  • Personal insurance is recommended.

7. Intellectual Property

  • All MoveQ systems, methods, frameworks, and materials remain the intellectual property of MoveQ.

  • No reproduction, teaching, or commercial use is permitted without written consent.

8. Media Consent

  • Participants consent to photo/video recording for:
    education, analysis, marketing, communication.

  • MoveQ retains full usage rights unless otherwise agreed in writing.

9. Data Protection

  • Data is processed under GDPR and EU law.

  • Used only for administration, communication, and service delivery.

10. Governing Law

  • These Terms are governed by applicable European law.

  • Disputes fall under relevant national jurisdiction.

11. Acceptance

  • Participation in any MoveQ service confirms acceptance of these Terms.
