3D PadelFit Terms & Conditions

These Terms and Conditions apply to all services provided by MoveQ, including Education Pathway, Holistic Sport Lab, and 3D PadelFit.

1. Contract Formation

  • A binding agreement is formed only when:

  • Any required application is approved (where applicable), and

  • Full payment has been received by MoveQ.

  • Submission of an application does not guarantee participation.

  • MoveQ reserves the right to decline participation at its discretion.

2. Payment

  • Full payment is required to confirm participation.

  • Failure to pay within the stated timeframe may result in cancellation of access.

3. Cancellation & Rebooking

  • Cancellations made more than 21 days before commencement may be eligible for a partial refund, excluding non-refundable fees.

  • Cancellations within 21 days are subject to a 75% fee.

  • Rebooking is subject to availability and approval.

  • Non-attendance is non-refundable.

4. Changes by MoveQ

  • MoveQ may cancel or reschedule services due to:
    low participation, staffing, safety, force majeure, operational requirements.

  • Participants may choose between:
    refund, or alternative date.

 

MoveQ is not liable for indirect costs (travel, accommodation, etc.).

5. Participant Responsibility

  • Participants must provide accurate information.

  • Participants must follow all safety and professional guidelines.

  • MoveQ may remove participants for misconduct, safety risk, or non-compliance without refund.

6. Liability

  • Participation is at the participant’s own risk.

  • MoveQ is not liable for:

         injury (unless caused by proven negligence), pre-existing conditions, personal             belongings, indirect losses.

  • Personal insurance is recommended.

7. Intellectual Property

  • All MoveQ systems, methods, frameworks, and materials remain the intellectual property of MoveQ.

  • No reproduction, teaching, or commercial use is permitted without written consent.

8. Media Consent

  • Participants consent to photo/video recording for:
    education, analysis, marketing, communication.

  • MoveQ retains full usage rights unless otherwise agreed in writing.

9. Data Protection

  • Data is processed under GDPR and EU law.

  • Used only for administration, communication, and service delivery.

10. Governing Law

  • These Terms are governed by applicable European law.

  • Disputes fall under relevant national jurisdiction.

11. Acceptance

  • Participation in any MoveQ service confirms acceptance of these Terms.

Service Appendix – 3D PadelFit Pathway

This Appendix applies specifically to 3D PadelFit services delivered by MoveQ and operates in conjunction with the MoveQ Master Terms and Conditions.

1. Service Nature

  • 3D PadelFit provides sport-specific performance training, movement development, and structured on-court coaching.

  • The programme is designed to enhance physical performance, coordination, and game- related capacity.

  • It does not constitute medical treatment, physiotherapy, or rehabilitation unless explicitly stated.

2. Athlete Readiness and Responsibility

  • Athletes are responsible for ensuring they are physically fit to participate in training sessions.

  • Any injuries, limitations, or relevant health conditions must be disclosed prior to participation.

  • MoveQ reserves the right to adjust or restrict participation based on safety or performance suitability.

3. Training Load and Physical Risk

  • Training includes physical exertion, sport-specific movement, coordination drills, and performance-based load.

  • Participants acknowledge that all physical training carries inherent risk.

  • Participation is voluntary and undertaken at the athlete’s own risk.

4. Session Structure and Attendance

  • Sessions are scheduled in advance as part of a structured performance development programme.

  • Attendance is expected as part of the training process.

  • Missed sessions may be forfeited unless otherwise agreed.

  • Repeated non-attendance may result in suspension or termination from the programme.

5. Coaching Scope and Adaptation

  • Coaching focuses on performance development, movement efficiency, and sport- specific progression.

  • MoveQ reserves the right to modify:

  • training intensity, session structure, exercise selection, or progression pathways, based on athlete development, safety, or environmental conditions.

6. Performance Focus

  • 3D PadelFit is a performance system and does not replace medical care, physiotherapy, or rehabilitation services.

  • Athletes requiring clinical support are advised to consult qualified healthcare professionals.

7. Athlete Conduct and Standards

  • Athletes are expected to maintain professional behaviour and respect coaching instructions at all times.

  • MoveQ reserves the right to suspend or terminate participation where conduct compromises safety, performance environment, or programme integrity.

  • Such termination does not entitle refund under the Master Terms.

8. External Conditions

  • MoveQ may reschedule or adapt sessions due to:
    weather conditions, facility availability, coach availability, safety considerations, or operational requirements.

  • All changes are made to maintain training quality and athlete safety.

9. Data and Performance Information

  • Personal and performance-related data is processed in accordance with applicable European data protection law, including GDPR.

  • Data is used for coaching, analysis, communication, and service delivery purposes.

  • Anonymised data may be used for internal development and system improvement.

10. Media and Image Consent

  • By participating in 3D PadelFit, athletes consent to photography and video recording for: coaching analysis, performance documentation, educational use, marketing and communication.

  • MoveQ retains full usage and distribution rights unless otherwise agreed in writing.

  • Opt-out requests must be submitted prior to participation.

11. Liability

  • Participation is undertaken at the athlete’s own risk and responsibility.

  • MoveQ shall not be liable for: injury unless caused by proven negligence, pre-existing conditions, personal belongings, or indirect costs related to participation.

  • Athletes are advised to maintain appropriate personal insurance coverage.

12. Intellectual Property

  • All training systems, methodologies, movement frameworks, and performance models remain the intellectual property of MoveQ.

  • No part of the 3D PadelFit system may be copied, reproduced, taught, or commercially used without prior written consent.

13. Acceptance

  • By booking or participating in 3D PadelFit services, athletes confirm that they have read, understood, and agreed to this Appendix and the MoveQ Master Terms and Conditions.
